The company may still be fully liable. Under California’s AB5 law (Labor Code Section 2775 et seq.), companies bear the burden of proving a driver truly qualifies as an independent contractor under the ABC test. Most trucking and delivery companies cannot satisfy all three prongs of that test. If the company controlled the driver’s schedule, provided the vehicle, or directed how the work was performed, the driver is likely an employee under California law and the company is responsible for the crash. We challenge independent contractor classifications regularly.

In most cases, two years from the date of injury under California Code of Civil Procedure Section 335.1. For wrongful death claims, two years from the date of death. However, if the truck was operated by a government entity — the City of Los Angeles, LA County, Caltrans, or a transit agency — you have only six months to file an administrative claim under the California Government Claims Act, or you permanently lose your right to sue. Do not wait to contact an attorney. Critical evidence including black box data, ELD records, and dashcam footage can be destroyed within days of a crash.
