Yijing Chen v. Nicole Hershel

$18 Million Verdict for Young Woman who Lost her Mother

Yijing Chen was crossing the roadway on a green light, while holding the hands of her mother Hong Fen Shen. Nicole Hershel, who was driving a pickup truck, did not see the pedestrians and ran over them. As a result Yijing fractured her leg, and Hong Fen died as a result of her injuries. There were no witnesses to the accident, so Nicole Hershel began to stage the scene to make it look like she was just an innocent bystander. She moved her truck, moved the unconscious Hong Fen, and told the investigating officers that she was just driving by when she saw the two women in distress in the street.

Other attorneys had gave up on the case, but ElDabe Ritter did not quit. Through litigation they were able to prove that Hershel caused the collision. At trial, ElDabe Ritter was able to prove that she maliciously staged the scene which caused additional emotional distress to Yijing. The jury agreed, and awarded $18,000,000 in damages.

$7.4 Million Verdict for Young Woman Whose Leg was Crushed between Two Vehicles

ElDabe Ritter attorneys obtained a 7.4 million verdict for a 31 year old woman who was severely injured while stopped on the side of the freeway. She was involved in a minor fender bender, and moved over to the shoulder of the freeway, along with 3 other cars. As she was standing outside her car, a commercial truck made an illegal lane change and struck a passenger vehicle, causing it to lose control and careen towards our client. She was crushed in between the front of that vehicle and the back of her own vehicle. The commercial vehicle fled the scene. However, during trial it was proved that he was responsible for the collision.

The collision caused damage to her popliteal artery, that supplies blood to her lower leg. She underwent a bypass surgery to repair the artery, asd well as extensive skin graft surgeries. With the interests and costs the Defendant is now responsible for over $7,000,000.

$6 Million Settlement for Woman Severely Injured as Motorcyclist Passenger

Kimberly A. was a passenger on a motorcycle in a canyon road in Orange County. The driver of her motorcycle was attempting to make a right turn, when he was cut off by a commercial truck. The truck driver argued that the motorcyclist was trying to pass on the right, because he was going slow. The police report found that the motorcyclist was at fault.

ElDabe Ritter through meticulous discovery and depositions were able to reveal that the truck driver had made a last second right turn, from the center line. As a result, a settlement of $6,015,000 was reached.

Estate of Ernest C v Omar C Trucking

$5.5 Million Verdict for Wrongful Death Car Accident

ElDabe Ritter attorneys obtained a 5.5 million jury verdict for the wrongful death of Ernest, a cherished husband, father and community member. Defendant Omar Castillo drove his fully-loaded big rig into Ernest Clark and his parked car on the freeway, thereby resulting in Clark’s death.

An exhaustive investigation by ElDabe Ritter revealed that Castillo was sleep deprived, distracted by phone usage and driving at a dangerous speed taking into consideration the lighting conditions. Mark Lyle was traveling on his motorcycle when the defendant’s vehicle collided with him, thereby resulting in the premature death of a beloved husband and father.

Initially, it appeared that the family would only recover the $15,000 policy limits of the driver. Instead of accepting a quick settlement. ElDabe Ritter filed a lawsuit and dug and dug, until they found out that the driver was in the course and scope of her employment at the time of the incident. Even though the connection between the driver and her employer were not completely clear because she had not started working yet. However, ElDabe Ritter was able to prove to the court that there was a sufficient nexus to her driving and the accident to allow a settlement of $2.45M to be reached.

Emily C. v Doulat

$4.3 Million Settlement for Wrongful Death of a Motorcyclist

Plaintiff Victor Chavez was fatally hit when the Defendant failed to yield at a stop sign and made a left turn. Chavez suffered from traumatic brain injuries and was pronounced dead within a few hours. ElDabe Ritter attorneys argued that Defendant was acting negligently and carelessly by failing to yield, operating a cellular device while driving, and not exercising reasonable care while operating a vehicle.
